Who said that lawsuits weren't out of control?
If this lawsuit were to succeed, what is next? Amplifiers for guitars? Television sets that are played too loud? Radios? I wonder if Mr. Patterson realized that there is a volume control on his iPod.
Patterson's lawsuit accuses Apple of marketing defective products that damage the hearing of those who use the devices, specifically iPods. Patterson is seeking class action status for his suit. Patterson's complaint seeks a court order that would require Apple to upgrade the product and compensate victims for hearing loss.
UPDATE: Apparently it is being claimed that the lawyer behind this suit has worked frequently for Microsoft in the past.

Thanks, Bill. On your case, I don't understand how people who claim that they support freedom of choice for women don't want to let Wal-Mart decide what they want to sell.
Nanny: That's what government has become to us. Hearing loss is a major problem in the country but no law will ever fix that: Education might.
Most people do not know that the amount of time you are exposed to noise has just as much to do with hearing loss as how loud the noise is. There was an article published in The Rolling Stone, with a comparitive chart.

For this device to cause permanent hearing loss it would have to be a prolonged exposure. Certainly long enough for him to remove the plugs from his ears. Any attorney worth his salt should be able to argue this one away. The sad part is corporate attorneys don't come cheap and Apple will probably settle out of court to avoid the headache and this guy will get rich for being stupid....ultimatly at yours and my expense.
