Another broken promise by Obama

From Jonathan Turley:

While many predicted it, Obama has now again betrayed the civil liberties community ... Americans will now be subject to indefinite detention without trial in federal courts in a measure supported by both Democrats and Republicans. It is a curious way to celebrate the 220th anniversary of the Bill of Rights. This leaves Ron Paul as the only candidate in the presidential campaign fighting the bill and generally advocating civil liberties as a rallying point for his campaign. . . .

If Congress, and the POTUS are willing to engage in illegal activities of this scope, what is to prevent Obama from using the mess in the Middle East/Southwest Asia as an excuse to suspend, or negate the upcoming election in 2012?

As an afterthought, why is it that illegal laws are legal until overturned by the SCOUTUS? Did not Marbury v Madison clarify that issue?

U.S. Constitution, Article 1, Section 9: "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."

Just exactly how do they get around this, again?
